These terms and conditions outline the rules and regulations for the use of Some of a Kind’s Website: www.someofakind.co.uk.

By accessing this website we assume you accept these terms and conditions in full. Do not continue to use the Some of a Kind website if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Policy and any or all Agreements: Client, You and Your refers to you, the person accessing this website and accepting the Company’s terms and conditions. The Company, Ourselves, We, Our and Us, refers to Some of a Kind. Party, Parties, or Us, refers to both the Client and ourselves, or either the Client or ourselves. Services refers to the use of the website www.someofakind.co.uk. 

1. Website Use
You must be 18 years old in order to use our Services. If you are under 18 years old or the age of majority in your jurisdiction, then you may only use the Services with your parent or legal guardian's permission.

You are solely responsible for your actions when using the Services. In addition, you understand and agree that you will not do, attempt to do, cause any third party to do, or attempt to do, any of the following in connection with your use of the Services:
Transmit by any means any software, virus, malware, programme, code, file, or other material intended to interrupt, disrupt, alter, destroy, or limit any part of the Services;
Use any robot, spider, script, or any manual or automated application or means to extract, download, retrieve, index, mine, scrape, reproduce, or circumvent the presentation, operation, or intended use of any feature, function, or part of the Services;
Submit any offensive, indecent, hateful, racist, sexist, pornographic, or otherwise inappropriate or obscene content (as determined by us in our sole discretion);
copy, download, distribute, transmit, upload, or transfer content from the Services or the personal information of others without our prior written permission or authorization;
Impersonate or pretend to be anyone else but you;
Violate or infringe upon the privacy, publicity, intellectual property, or other proprietary rights of third parties;
Engage in any activity that is criminal or tortious in nature, or otherwise contrary to the law or infringes the rights of another including, without limitation, fraud, stalking, defaming, abusing, harassing, or threatening.

If you breach any part of these Terms, we reserve the right to terminate your access to the Services.

2. Data Protection
We will only process your data in accordance to our privacy policy. 

3. Products
We make every effort to display as accurately as possible the colours, features and any defects with the products, especially as these are second-hand products. However we cannot guarantee that the colours, features and defects photographed and listed will be accurate, reliable or free from errors. Your electronic display may not accurately reflect the colours of the products or show the defects in their true form.

If you are unhappy with a product you have 30 days to return it to us as per our returns policy. 

4. Pricing
All prices are inclusive of VAT, and exclude delivery charges which will be shown in the checkout. All pricing is in GBP.

We reserve the right to amend pricing at any time.

Delivery is charged at a flat rate of £3.99 aside from ‘heavy items’ over 2KG which will be charged at the discretion of the Company. The product page will reflect the delivery cost before the point of purchase.

5. Our Contract
A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you.

6. Payment
You can only pay for items on our Site using any one of the following methods:

Diner’s Club

Union Pay
Apple Pay
PayPal

When you use a payment card you confirm that the card being used is yours or that you have been specifically authorised by the owner of the payment card to use it.

All payments are subject to validation checks and authorisation by the payment service provider. If the payment service provider refuses to authorise payment to us, we will not be liable for any delay or non-delivery. 

We reserve the right to refuse any payment or cancel any order.

7. Liability
Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

The Services and any goods purchased by you in connection with the Services are supplied only for domestic and non-commercial, private use. You agree not to use the same for any commercial, business or re-sale purposes. We have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

8. Your Rights
You have certain rights under the law. In the United Kingdom, these include:
that any products you order through this site will be of satisfactory quality, fit for their intended purpose, and conform to any description given on this site; certain remedies if a product is defective; and a right to cancel any order for a product within 14 days after the date of receipt of the product, and receive a full refund even if it is not defective. Nothing in the terms of service is intended to affect these rights.
